Article 1 - Purpose and scope
These rules are drawn up by TGMASTER HOLDING, trading under the Uwewer brand (hereinafter "Uwewer"), in accordance with articles L6352-3, L6352-4 and R6352-1 to R6352-15 of the French Labour Code. They apply to anyone following an Uwewer course, online or in person (hereinafter "the participant"), throughout the course.
They set out the health and safety rules, the rules of conduct, the nature and scale of sanctions and the procedural safeguards available to participants. They are provided to each participant before final registration and remain available on uwewer.com.
Article 2 - Health and safety
2.1 Each participant looks after their own safety and that of others by following the general and specific health and safety instructions of the training venue, in particular fire and evacuation instructions, which are presented at the start of the course.
2.2 When the course takes place on the premises of a company or establishment that already has its own internal rules, the applicable health and safety measures are those of those rules (article R6352-1 of the French Labour Code).
2.3 Smoking and vaping are prohibited in training rooms, as are bringing in or consuming alcoholic drinks or narcotics, and attending the course under their influence.
2.4 Any accident or incident occurring during the course, even minor, is reported immediately to the trainer, who informs Uwewer.
Article 3 - Online courses
3.1 Participants log in with their own credentials, which are strictly personal, and give their first and last name when joining the session.
3.2 They dress and behave as they would in a training room: they mute their microphone when not speaking, use the chat courteously and do not share any content unrelated to the course.
3.3 Recording a session, in whole or in part, or taking screenshots showing other participants, is prohibited without the written permission of Uwewer and of the people concerned.
Article 4 - Attendance and times
4.1 Participants respect the times given at registration. They inform the trainer or Uwewer, at contact@uwewer.com, of any lateness or absence, and give the reason.
4.2 Attendance is recorded by an attendance sheet signed for each half-day in person, and by connection records online. These records are used to issue the certificate of attendance and may be sent to the employer or the funder of the course.
4.3 Participants may only leave the course before the scheduled time after informing the trainer.
Article 5 - Conduct and use of equipment
5.1 Each participant behaves respectfully towards the trainer, other participants and the staff of host venues. Any discriminatory, abusive or violent remark or behaviour, or any form of harassment, is prohibited.
5.2 Equipment, access to Oracle training environments and materials provided are used solely for the course, in line with the trainer's instructions, and returned in good condition. Any anomaly is reported to the trainer.
5.3 Training materials are protected by copyright: they are reserved for the participant's personal use and may not be reproduced or distributed.
Article 6 - Sanctions
6.1 Any breach of these rules by a participant may lead to a sanction. A sanction is any measure, other than verbal remarks, taken by Uwewer's manager or their representative following conduct by the participant considered to be at fault, whether or not that measure immediately affects their attendance or the continuity of the course they are following (article R6352-3 of the French Labour Code).
6.2 Depending on the seriousness of the facts, sanctions are, in increasing order: a written warning; temporary exclusion from the course; permanent exclusion from the course.
6.3 Fines and other financial sanctions are prohibited (article R6352-3 of the French Labour Code).
Article 7 - Disciplinary safeguards
7.1 No sanction may be imposed without the participant having first been informed in writing of the complaints against them (article R6352-4 of the French Labour Code).
7.2 When a sanction affecting, immediately or not, their attendance is being considered, the participant is summoned by registered letter or letter delivered by hand against receipt, stating the purpose of the meeting, its date, time and place, and the possibility of being accompanied by a person of their choice, in particular another participant. During the meeting, the reason for the proposed sanction is explained and the participant's explanations are heard (article R6352-5).
7.3 The sanction may not be imposed less than one clear day or more than fifteen days after the meeting. It is the subject of a written, reasoned decision, notified to the participant by registered letter or delivered by hand against receipt (article R6352-6).
7.4 When the conduct has made a precautionary temporary exclusion with immediate effect essential, no final sanction may be imposed without following the procedure above (article R6352-7).
7.5 Uwewer informs the participant's employer, when they are an employee following the course under the skills development plan, and the organisation that paid for the course, of the sanction imposed (article R6352-8).
Article 8 - Participant representation
Uwewer courses last less than 500 hours: the election of participant representatives provided for in articles R6352-9 et seq. of the French Labour Code does not apply. Each participant may send their comments and complaints to contact@uwewer.com.
Article 9 - Publication and entry into force
These rules are provided to each participant before final registration and published on uwewer.com. They come into force on 5 October 2026.
